In the latter case, the data will be deleted once these reasons no longer apply.
General information on the legal basis for data processing
If you have consented to data processing, we process your personal data on the basis of Art. 6(1)(a) GDPR or Art. 9(2)(a) GDPR. If your data is required to perform a contract or to carry out pre-contractual measures, we process it on the basis of Art. 6(1)(b) GDPR. To comply with a legal obligation, we process data on the basis of Art. 6(1)(c) GDPR. Otherwise, processing is based on our legitimate interest in the secure operation and verifiability of this register pursuant to Art. 6(1)(f) GDPR. The legal basis applicable in each individual case is set out in the following sections.
Withdrawal of your consent to data processing
Many data processing operations are only possible with your express consent. You can withdraw consent you have already given at any time. The lawfulness of the data processing carried out until the withdrawal remains unaffected.
Right to object to data collection in special cases (Art. 21 GDPR)
If data processing is based on Art. 6(1)(e) or (f) GDPR, you have the right to object at any time to the processing of your personal data on grounds relating to your particular situation; this also applies to profiling based on these provisions. The legal basis on which processing is based can be found in this privacy policy. If you object, we will no longer process your personal data concerned unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the establishment, exercise or defence of legal claims (objection pursuant to Art. 21(1) GDPR).
Right to lodge a complaint with the competent supervisory authority
In the event of violations of the GDPR, you have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, your place of work or the place of the alleged violation. The authority competent for us is the State Commissioner for Data Protection and Freedom of Information of North Rhine-Westphalia (Landesbeauftragte für Datenschutz und Informationsfreiheit Nordrhein-Westfalen), Kavalleriestraße 2–4, 40213 Düsseldorf, Germany. The right to lodge a complaint is without prejudice to any other administrative or judicial remedies.
Right to data portability
You have the right to have data that we process automatically on the basis of your consent or in performance of a contract handed over to you or to a third party in a common, machine-readable format. If you request the direct transfer of the data to another controller, this will only be done insofar as it is technically feasible.
Access, rectification and erasure
Within the scope of the applicable statutory provisions, you have the right at any time to free information about your stored personal data, its origin and recipients and the purpose of the data processing and, where applicable, a right to rectification or erasure of this data. You can contact us at any time regarding this and any other questions about personal data.
Right to restriction of processing
You have the right to request the restriction of the processing of your personal data. You can contact us at any time for this purpose. The right to restriction of processing applies in the following cases:
- If you dispute the accuracy of your personal data stored by us, we usually need time to verify this. For the duration of the verification, you have the right to request the restriction of processing.
- If the processing of your personal data was or is unlawful, you can request the restriction of processing instead of erasure.
- If we no longer need your personal data but you need it to exercise, defend or assert legal claims, you have the right to request the restriction of processing instead of erasure.
- If you have lodged an objection pursuant to Art. 21(1) GDPR, your interests and ours must be weighed against each other. As long as it has not yet been determined whose interests prevail, you have the right to request the restriction of processing.
If you have restricted the processing of your personal data, this data may, apart from being stored, only be processed with your consent or for the establishment, exercise or defence of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the European Union or a Member State.
SSL or TLS encryption
For security reasons and to protect the transmission of confidential content, this site uses SSL or TLS encryption. You can recognise an encrypted connection by the address bar of your browser changing from “http://” to “https://” and by the lock symbol in your browser bar. When encryption is activated, the data you transmit to us cannot be read by third parties.
4. Data collection on this website
Server log files
The provider of these pages automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are:
- browser type and browser version
- operating system used
- referrer URL
- host name of the accessing computer
- time of the server request
- IP address
This data is not combined with other data sources. The data is collected on the basis of Art. 6(1)(f) GDPR. We have a legitimate interest in the technically error-free presentation and the security of this website; for this purpose, the server log files must be recorded. The data is deleted as soon as it is no longer required for these purposes.
Cookies
This website only uses technically necessary cookies. Cookies are small text files that are stored on your device and do not cause any damage.
- Language selection: When you switch between the German and the English version, the multilingual extension we use stores your selection in a cookie so that the selected language is retained the next time you visit.
- Login to the internal area: For logged-in employees and contracted service providers, the content management system sets session and login cookies that are required to operate the protected area.
These cookies are technically necessary to provide the functions you have requested. They are stored on the basis of Art. 6(1)(f) GDPR and Section 25(2) TDDDG; consent is not required for this. You can set your browser to inform you about the setting of cookies, to allow cookies only in individual cases or to exclude them in general. If cookies are deactivated, the functionality of this website may be limited.
We do not use analytics, marketing or tracking cookies. For this reason, we do not ask for cookie consent.
Enquiries by email or phone
If you contact us by email or phone, your enquiry, including all resulting personal data, will be stored and processed by us for the purpose of handling your request. We do not pass this data on without your consent.
This data is processed on the basis of Art. 6(1)(b) GDPR if your enquiry is related to the performance of a contract or is necessary to carry out pre-contractual measures. In all other cases, processing is based on our legitimate interest in the effective handling of enquiries addressed to us (Art. 6(1)(f) GDPR) or on your consent (Art. 6(1)(a) GDPR), if this has been requested.
The data you send to us via contact requests will remain with us until you ask us to delete it, withdraw your consent to storage or the purpose for storing the data no longer applies. Mandatory statutory provisions, in particular statutory retention periods, remain unaffected.
5. The Award Mark Register
Purpose and content of the register
This register makes the award marks granted by the EUPD Group publicly verifiable. For each award mark, the award granted, the awarded company, a unique seal ID, the period of validity and the current status are published. The purpose is to protect against the misuse of seals and to provide transparency to the market.
The published information relates to companies and their awards and, as a rule, does not constitute personal data. Where an awarded company is run as a sole proprietorship or partnership and its company name contains the name of a natural person, the published information may exceptionally relate to a person. In these cases, publication is based on Art. 6(1)(b) GDPR within the framework of the award relationship and on our legitimate interest in a verifiable register pursuant to Art. 6(1)(f) GDPR.
Expired and revoked award marks remain accessible in the register and are marked as expired or revoked. This continued publication is necessary so that older seals and QR codes still in circulation can be reliably verified.
Data of contact persons at awarded companies
To handle the award and verification process, we store the name and business email address of the contact person at the awarded company internally. This information is not published and is only visible to authorised employees in the protected internal area. The legal basis is Art. 6(1)(b) GDPR and Art. 6(1)(f) GDPR, as the contact details are required to carry out the award relationship. The data is deleted as soon as it is no longer required for this purpose and no statutory retention periods apply.
Access via seal ID and QR code
Each award mark can be accessed via its seal ID and via a QR code. The QR codes are generated and delivered on our own server; no external QR service is used. When the verification page is accessed, no data is collected beyond the usual server log files. There is no evaluation of who checked which award mark and when.
Search and filters
The search and the filters in the register are evaluated on the server in order to display matching results. Search terms are not stored permanently, are not assigned to any user profile and are not transmitted to third parties.
6. Internal area for employees
User accounts and login
There is a password-protected area for employees of the EUPD Group and contracted service providers in which award marks are created, reviewed and approved. Self-registration is not possible; accounts are created exclusively by the administration. The data processed includes the user name, name, business email address, a password stored in encrypted form, the assigned role and responsibility, as well as information on who created, edited or approved an award mark.
This processing is carried out to perform the employment or service relationship (Art. 88 GDPR in conjunction with Section 26 BDSG (German Federal Data Protection Act), Art. 6(1)(b) GDPR) and on the basis of our legitimate interest in a traceable and secure review process (Art. 6(1)(f) GDPR). The information on editing and approval serves to make the maintenance of the register traceable and is stored for as long as the respective award mark is published. User accounts are deleted or deactivated when the access authorisation ends.
Password reset
Authorised users can reset their password using the “Forgot password” function. A message with a time-limited link is sent to the email address stored in the account. The legal basis is Art. 6(1)(f) GDPR, as the function is required for the secure operation of the protected area.
Notifications in the review process
While an award mark is being processed, the system sends automatic emails to the responsible internal recipients, for example to the graphics team as soon as a mark has been created and to the responsible specialist team as soon as the seal image has been uploaded. The messages contain the information about the award mark required for the process as well as the business email addresses of those involved. The legal basis is Art. 6(1)(f) GDPR, as the notifications are required for the orderly course of the review process.
7. Services and extensions used
Fonts (hosted locally)
For consistent display, this website uses fonts that are stored locally on our own server and delivered from there. When a page is accessed, no connection is established to third-party servers (e.g. Google), and no personal data is transmitted to third parties.
Multilingual support
For the German and English versions of this website, we use an extension that runs entirely on our own server. No data is transmitted to third parties; only the language you have selected is stored in a technically necessary cookie.
